Impossible to know. Most are tied up in confidentiality clauses anyway.
Better to start with worst case legally and work back from there.

How strong is their case / how weak you? Whats their length of service? Is there a protected angle here (race, sex etc) that will push up?
Whats your normal redundancy policy? How badly do you want them to go quietly?
How likely are they to take you to an ET?
All those go into the melting pot.
